Феномен нотаріуса в бутті сучасної людини та суспільства (екзистенціальні та соціокультурні виміри)

Дане дослідження присвячене розгляду соціокультурних й екзистенціальних вимірів діяльності нотаріуса як одного з найважливіших суб’єктів правової кристалізації суспільства. Навіть людина, яка є носієм свавільної волі, звертаючись до нотаріуса, усвідомлює необхідність розумно-вольового способу існування себе самої, всіх інших людей, держави, суспільства і людства в цілому. Наукова новизна дисертаційного дослідження полягає в доведенні того, що нотаріус і нотаріальна спільнота є фактором становлення й розвитку сучасної української держави в напрямку набуття нею статусу демократично- правової, що прагне до сталого соціального розвитку суспільства. Це спрямовує наше суспільство до гуманістичної суб’єктності, яка означає включення України в європейську спільноту рівноправним членом.

The notary and the notarial community as individual and collective subjects who not only regulate the legal relations of people in society and of a person and society based on strict observance of laws but also can actualize the development of legal consciousness comprehensively and systematically considered. It is noted that the basis for this understanding is the fact that any type of human activity in the rule-of-law state requires its notarization - only in this case it becomes legitimate.
This is facilitated by the professional community composed of notaries. These are individuals who understand what a person is as a sovereign of his or her own reasonable will, and what the rule of law is as an institution for managing human rational and volitional intentions that form the basis of mature legal consciousness. The scientific novelty of the work is to prove that the notary and the notary community are essential factors in the formation and development of the modern Ukrainian state towards the acquisition of the status of a democratic and legal state aimed at the sustainable social development of society. This directs our state and society towards humanistic subjectivity, which means Ukraine's inclusion in the European community as an equal member.
