Поняття «соціальний захист» в контексті аналізу наукових досліджень: основні характеристики

Стаття присвячена аналізу наукових розвідок провідних вчених щодо сутності поняття «соціальний захист». Важливість теми полягає в створенні алгоритму реального забезпечення прав і свобод особи в Україні через бажання України стати повноправним членом Євросоюзу. Враховуючи актуальність правового регулювання соціального захисту на сучасному етапі, його фактична не сформованість, неоднозначність трактувань науковцями понятійно-категорійного апарату, стає необхідним подальше вдосконалення сутності даної дефініції. Стаття має на меті, аналізуючи наукові дослідження вчених періоду незалежності України, узагальнити та оцінити інтерпретації сутності поняття, розкрити його зміст через призму забезпечення і дотримання прав людини в Україні. Це зумовлено недостатнім рівнем розробки теоретичних підходів до визначення сутності соціального захисту населення, його компонентів. В статті означено витоки формування поняття «соціальний захист» та його історичний зв’язок з «соціальним забезпеченням». За результатами аналізу було визначено декілька позицій тлумачення поняття, а саме: соціально-правові гарантії та їх законодавче закріплення та система засобів і заходів. Деякі дослідники пішли шляхом об’єднання кількох відправних термінів: система пріоритетів і механізмів; система заходів й установ; гарантії, засоби й заходи; система соціальних відносин, охоронних заходів і правових гарантій; гарантії та інститути тощо. Доведено що розмаїття певних визначень пов’язано з різними підходами науковців до місця соціального захисту в системі суспільних відносинах, ролі соціального захисту в розбудові соціальної держави.

The article is devoted to the analysis of scientific investigations of leading scientists regarding the essence of the concept of “social protection”. Considering the relevance of the legal regulation of social protection at the current stage, its actual lack of formation, the ambiguity of interpretations by scientists of the conceptual-categorical apparatus, it becomes necessary to further improve the essence of this definition. The article aims, by analyzing the scientific research of scientists during the period of independence of Ukraine, to summarize and evaluate the interpretations of the essence of the concept, to reveal its meaning through the prism of ensuring and observing human rights in Ukraine. Scientific research is based on a systematic analysis of scientific literature: full-text articles, monographs, dissertations, collections of scientific works, normative legal acts of current Ukrainian legislation, documents of the international community, reference and encyclopedic literature. According to the results of the analysis, several positions of the interpretation of the concept were determined, namely: social and legal guarantees and their legal consolidation and a system of means and measures. Some researchers have followed the path of combining several starting terms: a system of priorities and mechanisms; system of activities and institutions; guarantees, means and measures; a system of social relations, protective measures and legal guarantees; guarantees and institutions, etc. It is proved that the diversity of certain definitions is connected with different approaches of scientists to the place of social protection in the system of social relations, the role of social protection in the development of the welfare state.
